- Are you paid on a salary basis and not receiving additional overtime wages when you work more than 8 hours in a day or over 40 hours in a week? California law assumes that all employees – including salaried employees – are entitled to be paid at 1.
5 times their regular rate of pay (sometimes referred to as "overtime pay" or "OT") for all hours in excess of 8 per day or 40 per week.
- Are you not paid at the rate of 2 times your regular rate of pay for all hours worked over 12 hours in a day?
- Are you owed unpaid vacation hours from a past or current job?
- Does your employer make unauthorized deductions from your paycheck?
- Are you not provided with a 30-minute duty-free meal period each day before beginning your sixth hour of work each day?
- Are you not provided with a second 30-minute duty-free meal period each day before beginning your eleventh hour of work?
- Are you not provided with a 10-minute duty-free rest break on each day you work at least 3.

- Are you not provided with at least two separate 10-minute duty-free rest breaks on each day you work more than 6 hours?
